Bans and Appeals

Bans

All customers should behave in an acceptable manner on licensed premises. It is the right of a licensee under common law to exclude anyone from his or her premises for whatever reason, irrespective of the Pubwatch scheme.

Pubwatch can get involved if a member feels an individual should be banned from every Pubwatch member establishment. At one of the regular Pubwatch meetings, members can put a case forward for an individual to be banned from all participating premises.

The scheme is normally involved as a result of a more serious breach of acceptable behaviour on or in the vicinity of licensed premises.

For example:

  • Assault a member of staff or customer
  • Damage premises or property within
  • Sell or misuse drugs on the premises
  • Threaten violence
  • Use Anti Social Behaviour

If the members vote that a person should be banned they will be notified by letter as to the length of their ban. The person is then banned from all premises in that Pubwatch scheme.

When a ban has run its course without incident and is lifted by the Pubwatch members, the person or persons should be advised of this and that any repetition of their past behaviour could result in a further ban of longer duration.

Should there be a breach of the ban during the banned period then the ban is likely to be extended.

Appeals

A person who has been banned from entry onto licensed premises may lodge an appeal against the ban. Please click on the link below to make an appeal. Your appeal will be acknowledged in writing and be taken to the next Pubwatch meeting where the matter will be discussed by all members. You will then be informed in writing of the decision made by the members.
